FDA, CE & RoHS Compliance Guide for Oral Care OEM Products

Compliance is one of the most critical — and often most confusing — aspects of launching an oral care product. This guide breaks down the key certifications required for electric toothbrushes and water flossers in major markets.

United States: FDA Registration

Electric toothbrushes are classified as Class I or Class II medical devices by the FDA. Most standard sonic toothbrushes fall under Class I (general controls only), while those making specific therapeutic claims may require 510(k) premarket notification.

Key requirements: FDA facility registration, device listing, and labeling compliance (21 CFR Part 801).

European Union: CE Marking

CE marking is mandatory for products sold in the EU. For electric toothbrushes and water flossers, the relevant directives are:

  • LVD (2014/35/EU): Low Voltage Directive for electrical safety
  • EMC (2014/30/EU): Electromagnetic Compatibility
  • RoHS (2011/65/EU): Restriction of Hazardous Substances

You will also need a Declaration of Conformity (DoC) and technical file.

RoHS & REACH

RoHS restricts 10 hazardous substances including lead, mercury, and cadmium. REACH covers chemical safety across the supply chain. Both are required for EU market access and increasingly expected by global retailers.

Battery Compliance: UN38.3

All lithium battery products must pass UN38.3 testing for safe air and sea transport. This is non-negotiable for international shipping.
